You know discovery abuse is bad when it leads to a terminating sanction and a $5 million default judgment. It's probably even worse when the judgment is affirmed on appeal, given the skepticism appellate courts typically bring to default judgments. But discovery abuse must be really, really bad when the appellate court takes the further step of ordering a jury trial on punitive damages and suggests disbarment of trial counsel.
